In den letzten Jahren hat sich in Polen ein Kulturkampf mit zunehmend bedrohlichen Folgen für Lesben, Schwule, Bisexuelle, trans* und intergeschlechtliche Personen (LSBTI*) entwickelt. Politiker*innen der Regierungspartei PiS und ihres Koalitionspartners Souveränes Polen haben vielfältige Angriffe, auch über die öffentlich-rechtlichen Fernsehkanäle, auf die LSBTI*-Community gestartet, um ihre Mitglieder und Anhänger*innen zu mobilisieren. Unterstützt von den Bischöfen der katholischen Kirche und Initiativen christlich-fundamentalistischer Gruppen dämonisieren sie LSBTI* als Bedrohung für Kinder, Familien und die polnische Identität. Mit ihren Angriffen schüren sie den alltäglichen Hass und gewalttätige Übergriffe. Im Hinblick auf den kommenden Wahlkampf ist zu befürchten, dass dies noch einmal verstärkt wird. Umso wichtiger ist es, vor allem die wirtschaftlich schwächeren LSBTI*-Personen in ihrem rechtlichen Kampf für ein würdevolles Leben zu unterstützen. Deshalb wurde vor zwei Jahren der Rechtshilfefonds Prawo nie wyklucza als Projekt des Vereins Miłość nie wyklucza (Die Liebe schließt nicht aus) ins Leben gerufen. Dank der Unterstützung des LSVD, der Eddy-Hirschfeld-Stiftung und anderer Organisationen und Spenden aus Westeuropa konnten wir in den letzten zwei Jahren 80 Fälle betreuen und über 150 LSBTI* finanziell unterstützen. In den meisten Fällen geht es um die rechtliche Anerkennung des Geschlechts von trans* Personen. Weitere bemerkenswerte Fälle betreffen die rechtliche Verteidigung der Aktivist*innen der Initiative Der Atlas des Hasses (atlasnienawisci.pl). Diese Initiative, die die so genannten LSBTI*-freien Zonen in Polen dokumentiert hat, wurde von einigen Gemeinden, die auf der Website aufgeführt sind, mit Unterstützung der ultrakonservativen juristischen Denkfabrik und Lobbyorganisation Ordo Iuris verklagt. Letztes Jahr wurde zudem ein Programm für Rechtsberatung in weniger komplexen Fällen ins Leben gerufen - dieses Jahr wurde dieser Bereich von der Schweizer Botschaft in Polen unterstützt, um Rechtsberatung speziell für Trans*-Personen anzubieten. O-Ton des Mitbegründers des Rechtshilfefonds und Professors für römisches Recht an der Fakultät für Recht und Verwaltung der Warschauer Universität, Jakub Urbanik: „Unser Traum ist es, unseren Fonds überflüssig zu machen, indem wir einen rechtlichen und sozialen Wandel herbeiführen. Leider wird dies noch lange Zeit nur ein Traum bleiben...“ Wir alle sind aufgefordert, ein offenes und demokratisches Polen zu unterstützen und alldiejenigen, die sich für Demokratie, Rechtsstaatlichkeit und Vielfalt in Polen einsetzen, nicht allein zu lassen. You need either legal knowledge or money for a lawyer. I had neither. Today I have a judgment confirming my gender. Thanks to the professional help of the Fund, the case was closed without any problems. I am grateful that there is such an initiative which supports transgender people, because the state left us without any help. Barbara’s Story Three years of court battles over my daughter led me into debts. During several years of divorce proceedings, the homophobic judge gave vent to her prejudices and subjected the judgement to them. She forced my ex-husband to fight for sole custody of the child despite the preliminary agreement between us, because "a wife may want to raise her daughter with another woman!" In the end, she ruled the father's parenting skills superior, and implicitly equated my orientation with mental illness. I didn't want to give up. Thanks to the Law Does Not Exclude Fund I am going with my case to the Court in Strasbourg. This gives me hope. Sara’s Story I am very grateful to the Law Does Not Exclude Fund for helping me in my court battle to get a legal recognition of who I am and a formal correction of my metric gender. I'm still in high school, I don't work, I don't have any income. My mother is ill and has been unemployed for several years because of it. My foster dad and grandparents are very supportive of me and help us as much as they can. I am grateful to them for that. However, I did not expect such a willingness to help and such understanding from people who, after all, are not my family. The Fund has restored my faith in people and in society through its support, without which I would certainly have had great difficulty in dealing with the case in court. And every transgendered child in Poland has that faith shattered. The story of Atlas of Hate Paulina, Kuba, Paweł, and Kamil had the courage to speak out about the fact that Polish local governments in official documents (so-called "anti-LGBT resolutions") call for hate against LGBTIQ people and present our community as threat. On the website “Atlas of Hate” they have shown how 1/3 of Poland has become a zone "free of LGBT ideology", thus free of equal rights. Thanks to them, all of Europe learned about the zones. Seven local governments sued the team of “Atlas” for huge damages. This is the so-called SLAPP (strategic law suit against public participation) – an attempt to intimidate and silence people who look into the hands of the authorities. The Fund is currently supporting the team of Atlas of Hate by funding legal aid and the costs of ongoing proceedings. Paulina, Kuba, Paweł and Kamil are represented by a team of lawyers coordinated by Karolina Gierdal from the Bzdyń Gierdal Human Rights Law Office. The team also includes attorney Emilia Barabasz, attorney Alicja Szpringer, attorney Dorota Seweryn Stawarz and attorney Mikołaj Świstowski. Legal support has so far been provided by Polish Society of Anti-discrimination Law, Federacja Znaki Równości and Campaign Against Homophobia. More than 100 municipalities in Poland declared themselves “LGBTI-free zones”. They are implementing dangerous policies that directly violate the democratic values of equality and diversity. The PiS has been deliberately stirring up anti-LGBTI sentiment for years, and sexual and reproductive rights are being massively attacked and partially abolished in the Polish parliament. Yet legal action and community pressure may bring change. Thanks to the legal actions taken by the Former Ombudsman of the Republic of Poland Prof. Adam Bodnar (now a member of the Board of Law Does Not Exclude) several administrative courts have declared these statements unlawful and anticonstitutional.
